Terms and Conditions

The following Terms and Conditions will apply to all contract work performed by Murphy Made directly. These Terms and Conditions will be provided in hard copy for signature prior to any work undertaken or costs incurred by Murphy Made.

1. Engagement

Once work is authorized by the Customer, Murphy Made is committed to certain expenses both direct and indirect which are priced into the project.

If the project is canceled, delayed, terminated, or significantly changed through no fault of Murphy Made, these start-up expenses will be due and payable to Murphy Made on a pro-rata basis.

Any requests for reimbursements of these expenses will be itemized.

2. Payment

For larger projects, the Customer will agree to pay a percentage of the estimated price of the project at the beginning and make payments as work progresses.

For smaller projects, the Customer agrees to pay the entire balance upon completion of the project.

Any payment not received within ten (10) days from the invoice date will be subject to the maximum interest rate that Oklahoma State law will allow. After thirty (30) days, late fees and additional interest will apply as allowed by law.

3. Authority to Bind Property Owner

If the undersigned is not the property owner on record where the work is to be performed, then the undersigned represents that he/she is an authorized agent of the property owner and empowered to engage Murphy Made to perform the requested services.

The undersigned person and property owner will be jointly and severally liable for any charges assessed by Murphy Made for its work.

4. Changes to the Scope of Work

If the Customer desires or changes the scope of work by adding to it or making significant changes to the original project, then the Customer understands that the price could increase.

Murphy Made will notify the Customer in writing of any additional charges and increases prior to performing additional work.

If Murphy Made encounters any unforeseen circumstances that prevent or alter the scope of the project, we will notify the Customer and provide a new quote prior to continuing with the work.

5. Warranty and Limitations

Murphy Made warrants all workmanship, provided by MurphyMade, for a period of one (1) year.

Our warranty excludes material, fixtures, and/or Customer provided material and equipment.

Murphy Made warranty does not apply to work performed on behalf of a third party, service company, warranty company, or subcontractor.

Our warranty takes effect upon full payment to Murphy Made and is non-assignable.

This warranty is void if a third party performs work on the same item or project.

Murphy Made is not liable for damages caused by weather, normal wear and tear, routine maintenance, manufacturer defects, acts of God, third-party negligence, or neglect or abuse by the Customer or their agents.

Murphy Made provides no other warranties either express or implied.

6. Warranty Exclusions

Murphy Made is not responsible for any additional warranties either expressed or implied regarding merchantability and fitness for a particular purpose.

Murphy Made is not subject to and disclaims any other obligations or liabilities arising out of breach of contract or of warranty; any obligations whatsoever arising from tort claims including negligence and strict liability or arising under theories of law with respect to products sold or services rendered by Murphy Made, acts or omissions related thereto; and all consequential, incidental, punitive, or contingent damages whatsoever.

7. Sales

All sales of products and materials purchased through Murphy Made are final and nonrefundable.

8. Choice of Law and Fees

Any disputes arising out of this contract shall be governed by the laws of the State of Oklahoma.

The Customer also understands and agrees that he/she will be liable for any fees, costs, and attorney fees, incurred in the collection or resolution of a dispute by MurphyMade.

9. Incorporation by Reference

These Terms and Conditions are incorporated and become part of all proposals, work order changes, and credit agreements upon signature by the Customer.
